Getting Out From Under Sex Registration: Megan’s Law, Certificates of Rehabilitation and Pardons
California’s sex registration law (Penal Code section 290) is extremely complicated and seemingly ever-changing. Registered sex offenders often mistakenly believe that they must register for life during which time they will appear on the Megan’s Law website for all the public to see. In some cases, sex offender registration is for life and mandates inclusion on the website. However, some registered sex offenders can petition to have themselves removed from the Megan’s Law website. Also, some registered sex offenders can petition the courts to get off of their sex registration obligation after a period of time. This process may include an expungement under Penal Code section 1203.4 and/or a certificate of rehabilitation and/or applying for a governor’s pardon.
